This system enables access to enrollment data, coverage summaries, identification cards, and benefits-related support services. Products and services purchased through or provided by third-party websites are subject to the terms and conditions of such third parties, and BeneVibe shall have no liability or responsibility for such purchases.
Health-Related Information and HIPAA
The information system subject to this agreement is a web-based benefits administration system providing individualized health plan information.
● e-PHI: Because the system processes individually identifiable health information related to health plan enrollment and coverage, it qualifies as electronic Protected Health Information (e-PHI) under 45 CFR §164.302.
● Educational Purpose: The information provided via the Services relates to your physical or mental health, healthcare provision, or payment for healthcare. It is designed for administrative and educational purposes regarding your group health plan and is not a substitute for informed medical advice.
● User Rights: Under HIPAA, you have the right to inspect and copy your health records, request amendments, and receive an accounting of disclosures.
SMS Messaging Terms & ConditionsProgram Description
BeneVibe operates an SMS messaging program to deliver service-related communications to enrolled users. All messages are transactional in nature. BeneVibe does not send promotional or marketing messages via SMS. Account notifications and alerts

Opt-In Consent
By providing your mobile phone number and affirmatively opting in, for example, by checking a consent box or submitting a form, you expressly consent to receive SMS messages from BeneVibe.

BeneVibe does not charge for SMS messages. Standard message and data rates from your mobile carrier may apply. You are responsible for any fees charged by your carrier. Your mobile phone number and SMS opt-in data will never be shared with third parties or
affiliates for marketing or promotional purposes.

User Responsibilities
By participating in the BeneVibe SMS program, you agree to the following:

BeneVibe is not responsible for messages sent to reassigned, incorrect, or deactivated phone numbers.Changes to These Terms BeneVibe reserves the right to update or modify these Terms & Conditions at any time. Any changes will be reflected on our website with a revised effective date. Continued participation in the SMS program after changes are posted constitutes acceptance of the updated terms.
Modification
BeneVibe reserves the right to modify or discontinue, temporarily or permanently, the Website as a whole and any or all of the Website features, products, services, or information available through the Website, with or without notice to you. the laws of the jurisdiction in which BeneVibe operates, without regard to conflict of laws provisions. Any claim must be brought within the timeframes permitted by law, typically aligned with HIPAA’s retention and record requirements.
Arbitration and Class Action Waiver
Any controversy or claim arising out of or related to the use of the Website that cannot be resolved through informal negotiation shall be settled by binding arbitration. Termination of Agreement or Account
